The History of the Island Estates in Clearwater, FL

Did you know that Island Estates was originally part of the mainland? In the late 1800s, the United States government decided to build the Florida Intracoastal Waterway and excavated the East Coast Canal. Today, all that remains of the original canal is the waterway on the east side of Island Estates.

In the 1930s, the U.S. Corps of Engineers excavated a new canal, bypassing the East Coast Canal and separating Island Estates from the mainland. Unfortunately, this new island remained uninhabited until the 1980s, when developers began building houses there. In 1988, the Palm Coast Bridge opened, making the island much more accessible.

Island Estates continued to grow into the thriving community it is today. The island is home to:

At Roman Austin, our lawyers take on all personal injury cases, from car accidents and motorcycle accidents to wrongful death cases and more.

Car Accidents

A car accident can leave you with devastating injuries, a stack of medical bills, and an inability to work while you heal. Our lawyers can help you get the compensation you deserve. We’ll take on the insurance companies and fight to get you every penny you’re entitled to.

Bicycle Accidents

Bicyclists in Island Estates face more risks than other road users. Without the frame of a car to protect them, bicyclists often suffer more severe injuries than drivers. If you’ve been injured in a bicycle accident in Island Estates, our lawyers can help you get a fair settlement.

Motorcycle Accidents

A staggering 80 percent of motorcycle accidents result in injuries or death, and motorcycle accident injuries are often more severe. Worse yet, insurance companies often like to place blame for the accident on the motorcyclist. Our lawyers will protect you from blame and fight to get you a full and fair compensation package.

Slip & Fall

Property owners in Island Estates are required to maintain their property within reasonable safety guidelines. If they fail to do so and you’re injured, they could be liable for your injuries. Our lawyers will help you take on the insurance companies and legal teams to get the money you’re entitled to.

Truck Accidents

Trucks in Illinois can be up to twenty times as heavy as normal cars, which makes accidents with them even more devastating. And if you’ve been injured in one of these accidents, you could find yourself facing down not only the insurance giants, but also a trucking company. Our lawyers will fight for your rights and help you get justice in your case.

Wrongful Death

Losing a loved one is agonizing in any circumstances, but it can be unbearable if you know they didn’t have to die. In a wrongful death case, our lawyers will help you get justice for your loved one. We’ll make sure the person who caused their death is held responsible and get you a fair settlement.

Damages Available in Island Estates Personal Injury Cases

There are three basic kinds of compensation you can get in personal injury cases in Island Estates: economic, non-economic, and punitive.

Economic damages cover losses that come with an attached price tag. This can include everything from medical bills and lost wages to property damage and loss of future earning potential.

Non-economic damages compensate you for losses that don’t have an attached dollar value. This may include pain and suffering, loss of companionship, scarring and disfigurement, emotional trauma, mental anguish, and more.

Punitive damages are extraordinarily rare to recover in a personal injury case. They are meant to punish a defendant who acted in an especially heinous manner during an accident.

What Does It Cost to Hire a Personal Injury Lawyer in Pinellas County?

If you’re already drowning in medical bills and unable to work to pay for them, you may wonder how much you’ll have to shell out for a personal injury lawyer. The good news is you shouldn’t have to pay any money up front.

Most personal injury lawyers work on a contingency basis, which means they take their fees from a portion of the settlement they recovered for you. If they don’t recover any money in your case, you may not have to pay at all.

In most cases, a personal injury lawyer’s contingency fees will be around a third of what they recover for you. So if they get you $10,000, they’ll take $3,300 as their fee. Not only does this save you from having to pay up-front fees, but it also gives your lawyer even more motivation to recover as much money as possible in your case.

Statute of Limitations in Florida Personal Injury Cases

In personal injury cases, you have a limited amount of time to file a claim. You can’t claim damages for an injury you got twenty years ago. This time limit is called the statute of limitations, and in Florida, the statute of limitations on personal injury cases is typically two years.

You’ll have two years from the date of your injury to file a personal injury claim.

The deadline used to be four years from the accident date. However, Florida law was revised on March 24, 2023 to reduce the allotted time to file personal injury claims. Therefore, if your Island Estates accident occurred after that date, you have two years to take action.

In some cases, you might be able to file a claim after that two-year time limit has passed. For instance, if you don’t discover the full extent of an injury until after the statute of limitations has passed, you may be able to file a claim within two years after the date of discovery.

Although this may seem like a long time, it can fly by when you’re healing from an injury and trying to get your life back on track. It’s important to talk to a personal injury lawyer as soon as possible after your accident to start gathering evidence in your case.
