Who Is Liable in a Trinity Personal Injury Case?

Sometimes there is one clear party who is responsible for causing the accident. Other times, there may be multiple people who share responsibility. Ultimately, the person who acted negligently is the person who will be held liable.

In a personal injury case, the responsible party may include:

  • A driver
  • A company or a business
  • A property owner
  • An employer
  • The government

It is important that we thoroughly investigate all parties who contributed to your harm. When we file a personal injury claim, we may include multiple individuals as defendants. Including everyone responsible increases your chances of recovering full compensation through insurance or a lawsuit.

PIP Insurance & No-Fault Laws

When it comes to car accidents, Florida’s no-fault and PIP insurance laws may affect who is responsible for your damages. Florida law requires drivers to carry $10,000 in PIP insurance coverage.

PIP insurance is a no-fault policy that pays drivers and their passengers when they are hurt, no matter who caused the crash. When someone is hurt in a car accident, they must first file a claim through their PIP insurance policy instead of through the person who caused the accident.

PIP insurance is pretty limited. You can only recover up to 80% of your medical expenses and 60% of lost wages up to your policy limit. If you have damages exceeding the amount of your PIP insurance, you may be entitled to seek compensation from the other party.

We Represent Clients With Many Different Types of Injuries

Since there is a wide variety of personal injury accidents, there are a wide variety of injuries. We have represented clients with many different types of injuries. Sometimes they are minor, while other times, they are catastrophic and extremely complex.

Most commonly, our clients come to us with:

  • Traumatic brain injuries
  • Head injuries
  • Broken or fractured bones
  • Amputation
  • Severe burns
  • Neck or back injuries
  • Spinal cord injuries
  • Paralysis
  • Internal bleeding
  • Crushing injuries
  • Organ damage
  • Joint sprains and dislocations

These injuries can be permanent and disabling. Many clients will require years of treatment and therapy to return to normal. Some of them will never fully heal and must learn how to live in their new normal.

Roman Austin Personal Injury Lawyers will take the time to fully understand your injuries and discuss your case with medical professionals. This may include your doctors and outside expert witnesses. Then we can help you get the compensation you need to heal, pay medical bills, and compensate you for the change in your quality of life.

How Long Do I Have To File a Personal Injury Lawsuit in Trinity, Florida?

In Florida, you have two years to file most personal injury lawsuits. This is called the statute of limitations. If you miss this deadline, you will lose your chance to recover any money through the legal system.

It is important to note that the law has recently changed. Previously, there was a four-year statute of limitations. If your accident happened before March 24, 2023, you have four years to file a negligence-based claim. If your accident occurred after March 24, 2023, you have two years.

It’s best to consult a Trinity personal injury attorney immediately after getting hurt. They can explain what deadline applies in your case and ensure that you aren’t at risk of missing it.

Can I Still Recover Compensation Even If I Am Blamed For My Injuries in Florida?

Sometimes our clients are blamed for causing their injuries or contributing to an accident. This is frustrating but unfortunately common. If you are blamed for your accident, that doesn’t mean your case is over.

In Florida, the courts apply a modified comparative negligence law. This means you can recover money as long as you are 50% or less responsible for causing the accident. If you are more than 50% to blame, you lose your opportunity to recover any money at all.

The court will decide how much responsibility each party has for the accident. Then your damages are reduced by your share of responsibility. For example, if you are 30% responsible for causing the accident, you will receive only 70% of your damages. This may not be ideal, but it is better than nothing.

What Damages Are Available in a Trinity Personal Injury Case?

When you file a personal injury claim, the money that you recover is called damages. There are three different types of damages, and the total makes up your final award or settlement. The types of damages are economic, non-economic, and punitive.

Economic damages are financial losses that happen because of an accident or injury. These are calculated by looking at bills, receipts, and pay stubs.

In many cases, economic damages include:

  • Emergency medical bills
  • Follow-up doctor’s visits
  • Surgeries
  • Cost of pharmaceuticals
  • Medical devices
  • Transportation to and from appointments
  • Rehabilitation and physical therapy
  • Lost wages (past and future)
  • Lost future earning capacity
  • Long-term care or in-home care
  • Property damage

Non-economic damages are emotional and physical losses that happen after an accident or because of an injury. These types of damages are harder to calculate because it is unique to each person. Unlike economic damages, there is no bill or easily calculated dollar figure.

Examples of non-economic damages are:

  • Pain and suffering
  • PTSD, anxiety, or depression
  • Emotional anguish or suffering
  • Loss of enjoyment of life
  • Loss of consortium
  • Permanent disability or disfigurement
  • Inconvenience

Punitive damages are different from the previous types of damages. Punitive damages are only awarded to punish the defendant for extremely reckless or intentional behavior. You can only ask for punitive damages under certain circumstances.

You must prove that the defendant engaged in gross negligence or intentional misconduct when they caused the accident or your injury. This is a high bar. It means that the defendant knew they would hurt you or that they consciously disregarded that risk.

Punitive damage awards can be very high, but they aren’t easy to get. You should speak with your lawyer to see if you have grounds to ask for punitive damages in your case.
