Response from the owner: Keith: A lawyer’s duty to keep client confidences has few exceptions and in an abundance of caution we cannot reply specifically to the facts of your case in this forum. Speaking generally, one of the most disappointing things attorneys encounter, on a nearly daily basis, is an injury claim where the investigation reveals the absence of any insurance to cover the loss. It happens all too often. This firm has, in the past, filed lawsuits, and obtained large jury verdicts against uninsured defendants. But we have never recovered a penny on those judgments. We literally have hundreds of thousands of dollars of these worthless judgements. They are like very expensive wallpaper. Why are they worthless? Why isn’t it possible to recover money from someone who has no insurance to protect others from their negligent acts? The answer lies in Florida law. Florida law is very protective of debtors. First, it is important to remember that people who have assets typically protect them with insurance. People who have no assets, generally have no insurance. And, many assets are immune from creditor claims, like personal injury lawsuit judgments. A lawsuit can’t touch them. For example, in Florida, homestead law (embodied in our state constitution) protects people’s homes from creditor’s claims. So, if you own a home, no one can touch the equity (other than the bank that holds a mortgage). You can’t just “put a lien” on someone’s home. It’s impossible in Florida. Most assets people have are immune from personal injury lawsuits. Retirement plans? Immune from creditor claims, like injury lawsuit judgments. Many other assets are also immune from personal injury judgments. You can’t collect them if the assets are protected by law. Even if they weren’t immune from creditor claims, a lawsuit does not automatically entitle an injured person to go after someone’s assets. First, a lawsuit must be filed. There are filing fees, and other major expenses required to get an injury claim into a courtroom. Then, there would need to be a trial to determine damages. It takes a very long time to get a case to trial, and it is very expensive. If there is no hope of recovery, the effort is futile. A judgment must be obtained. Only then could that judgment be used to pursue assets that are not immune. What’s worse, one could go through all these steps, and pay those costs, only to have a defendant declare bankruptcy, ending the entire process with no recovery. The unfortunate reality, over which attorneys have no control, is the fact that many people who cause injuries will never be held accountable if they have no insurance. It is very difficult for our firm not to be able to help clients who have been seriously injured through no fault of their own when there is no insurance or other avenue of recovering compensation.
